California homeschooling ruling vacated


I received this in an e-newsletter from Family Leader today...

California Home School Case Vacated


 

Our friends at the Pacific Justice Institute have just received word that the court ruling which declared most forms of homeschooling unlawful in California has been vacated. This means the Rachel L. decision, which has sparked a nationwide uproar, will not go into effect as it is currently written. The Second District Court of Appeal has instead decided to re-hear the case, with a new round of briefings due in late April. It would likely take the court several additional months to schedule oral argument and issue another decision. Brad Dacus, president of Pacific Justice Institute, commented, "We are pleased that the Court of Appeal has decided to re-hear the Rachel L. case, and we are hopeful that the fundamental rights of these parents, our clients Sunland Christian School, and the tens of thousands of homeschooling families in California will be honored. Homeschooling parents should be treated as heroes-not hunted down or harassed by their own government."

Because of the potential for abuse, I'm not a fan of political pressure forcing courts to change their verdicts, even if the change benefits my point of view. Hopefully they have a good legal reason for reopening the case.

They have an excellent legal case. The judge had no legal basis to state that a parent needs a teaching certificate to homeschool their kid. It was bad precedent.
And I'm actually all for the ability to speak out against and act to change bad precedent. Judges are only human, and they will make mistakes. If it's a mistake as hugely bad as this one, then public outcry can change it.
Can that work against justice? Can public outcry get a good ruling thrown out? Unfortunately, yes, but that's the price of having this method of redressing grievances. Remember what the scriptures say? If the voice of the people chooses evil, then you're in a world of hurt. But I'd rather the chance of the method being misused than to have that method taken away.
